Welcome to FarmEquipRent. These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing or using FarmEquipRent, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using our services.
2. Service Overview
FarmEquipRent provides an online platform that connects farm equipment owners (“Owners”) with individuals or businesses looking to rent agricultural machinery (“Renters”). We facilitate the booking and listing process between users. However, FarmEquipRent is not responsible for the payment transactions between Owners and Renters, nor the physical transportation of equipment.
3. User Accounts
Registration: To use our services, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
Eligibility: You must be at least 18 years old to register and use our services. By creating an account, you represent that you meet this age requirement.
Account Responsibilities: You are responsible for all activity under your account. If you suspect any unauthorized use of your account, please notify us immediately.
4. Booking and Renting Equipment
Listing Equipment: Owners may list their equipment for rent, providing accurate descriptions, availability, and pricing. Owners are responsible for ensuring that their equipment is in safe, working condition.
Booking Equipment: Renters can browse and book equipment by selecting their desired dates and agreeing to the terms of the rental. FarmEquipRent only facilitates the listing process and charges a small service fee.
5. Transportation of Equipment
FarmEquipRent does not provide transportation services for the machinery. The responsibility for delivering and returning the equipment lies solely with the Owner and the Renter. Any arrangements for transportation must be made directly between the parties involved, and FarmEquipRent will not be held liable for any issues related to transportation or delivery.
6. User Responsibilities
Owners: By listing equipment on FarmEquipRent, you agree to provide accurate information about your equipment, maintain it in good condition, and honor confirmed bookings.
Renters: By booking equipment, you agree to return the machinery in the same condition in which you received it, and to use it responsibly, adhering to any agreed-upon rental terms.
Both Parties: Users agree to comply with all applicable laws, regulations, and safety standards during the rental process.
7. Cancellations and Refunds
Cancellations by Renters: Renters may cancel a booking according to the cancellation policy set by the Owner. If the cancellation qualifies for a refund based on the Owner’s policy, FarmEquipRent will process the refund on behalf of the Owner, deducting any applicable service fees. Refund amounts will depend on the cancellation terms outlined by the Owner.
Cancellations by Owners: Owners may cancel a booking in exceptional circumstances. In such cases, FarmEquipRent will facilitate the refund to the Renter if applicable. Any compensation, if offered, is at the discretion of the Owner, and FarmEquipRent will assist in processing any agreed-upon refund.
Refund Policy: Refunds, if applicable, will be processed by FarmEquipRent in accordance with the cancellation policies set by the Owner. FarmEquipRent’s service fee for facilitating the listing and booking process is non-refundable.
8. Fees and Payments
Service Fees: FarmEquipRent charges a small, non-refundable service fee to facilitate the listing and booking of machinery on the platform. This fee is transparently disclosed to users during the booking or listing process and is retained by FarmEquipRent to support platform operations.
Payment Processing: All payments for machinery rentals are processed through FarmEquipRent, which ensures secure and timely transactions between the Renter and the Owner. Once the Renter pays, FarmEquipRent deducts the service fee and remits the remaining rental payment to the Owner.
Payment Responsibility Disclaimer: While FarmEquipRent provides a platform for transactions, it is not responsible for payment disputes, errors, or delays that may arise between Owners and Renters. Any issues regarding payment or rental conditions must be resolved directly between the involved parties.
9. Limitation of Liability
Service Availability: While we strive to keep our platform available at all times, FarmEquipRent does not guarantee uninterrupted service and is not liable for any downtime or technical issues.
Third-Party Content: Our platform may include links to third-party websites or content. We are not responsible for the accuracy or availability of such external content.
Damages: In no event shall FarmEquipRent be liable for any indirect, incidental, or consequential damages arising out of your use of the platform, including but not limited to loss of income, data, or business.
Transportation and Payments: FarmEquipRent is not responsible for the transportation of rented machinery or any payment disputes between Owners and Renters.
10. Dispute Resolution
Owner-Renter Disputes: In the event of a dispute between an Owner and a Renter, FarmEquipRent may, at its discretion, offer assistance to help resolve the issue. However, FarmEquipRent is not liable for any disputes or issues arising from the rental agreement, including those related to transportation or payments.
Mediation: If a dispute arises from these Terms, the parties agree to attempt mediation before pursuing legal action.
11. Intellectual Property
All content, logos, graphics, and software on FarmEquipRent are the property of FarmEquipRent and are protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any part of the platform without our written permission.
12. Modifications to the Terms
FarmEquipRent reserves the right to modify or update these Terms at any time. Changes will be effective immediately upon posting the updated Terms on the platform. Continued use of the platform after any changes constitutes acceptance of the revised Terms.
13. Termination of Use
We reserve the right to suspend or terminate your access to the platform if we suspect you are in violation of these Terms or engaged in illegal or harmful activities. Any fees paid for services will not be refunded in the event of termination due to breach of these Terms.
